Am I included in the class?

You are included in the class if you purchased an “Affected Computer” that experienced a “Qualifying Symptom”. Click here for a list of “Affected Computers”. Click here for a list of Qualifying Symptoms.

How much money will I receive

We do not know how much your payment would be at this time. As described below, the amount of your compensation will be based on which model of Affected Computer you purchased, which symptoms you experienced, when you experienced them, and the number of claims that are filed and approved by the settlement administrator.

Total Loss of Use of an Affected Computer

This grid will be used to determine the compensation payable for the total loss of use and/or early failure of any Affected Computer:

A total loss of use shall be determined by the claims administrator upon receipt of satisfactory proof of purchase and a claimant’s declaration that they experienced a Qualifying Symptom. A total loss of use is defined as a circumstance whereby any Affected Computer is rendered totally or substantially unusable to its purchaser for the purposes for which it was designed due to the presence of Qualifying Symptoms.

Temporary Loss of Use of an Affected Computer
The claims administrator will compensate class members for temporary loss of use of an Affected Computer. Awards may be granted to settlement class members upon delivery of satisfactory proof of a loss of use and the duration of the loss of use by a declaration and reasonable supporting documentation.

Compensation for loss of use shall be calculated on the basis of $100 per month, or pro-rated as necessary.

A temporary loss of use is defined as any circumstance whereby a settlement class member lost the use of an Affected Computer due to the presence of Qualifying Symptoms on a temporary, rather than a permanent basis.

Reimbursement of Repair Expenses
The claims administrator shall receive and evaluate the proof of repairs and or remediation (ie data backup, the purchase of a cooling pad, the cost of replaced components etc.) provided by settlement class members. All proven repair/remediation costs which were not otherwise repaid to the settlement class member by another source and which are shown to be associated with the experience of Qualified Symptoms on an Affected Computer shall be paid in full.

Repair/remediation expenses may not exceed the original cost of the Affected Computer.

When will I receive my share of the settlement?

The distribution of the settlement fund will occur after the claim period has ended. The claim period is expected to take between 6 and 9 months. The deadline to submit a claim has been extended to May 30, 2014. It is likely that you will not be paid until the conclusion of the claim period. Please be patient.

Are there any important deadlines?

Yes, you must submit a claim by May 30, 2014.

What do I have to show/prove in order to claim compensation?

In order to make a successful claim be sure to provide the following:

  • Proof that you bought one or more Affected Computers by identifying the brand and model (e.g. an invoice, a product registration document, a credit card receipt or similar documents)
  • Proof of the date of your purchase of an Affected Computer
  • A description of the Qualifying Symptoms you experienced (e.g. distorted, scrambled or no video capability) and when they were experienced
  • A brief explanation of whether you lost the use of your computer permanently as a result of the Qualifying symptoms or temporarily until there was a repair
  • Proof of any out of pocket expenses you paid for in connection with the Qualifying Symptoms you experienced with the Affected Computer (e.g. repair bills, external memory drives, cooling pads, computer rental, shipping costs)

In order to receive compensation, you must provide proof of purchase of one of the Affected Computers. The following is a non-exclusive list of acceptable forms of proof of purchase:

  • sales receipt;
  • credit card or other account statement;
  • shipping manifest;
  • purchase order;
  • proof of registration;
  • such other documentation that the Administrator deems sufficiently reliable to demonstrate that one of the specified models was purchased in the specified purchase date range.

If you cannot locate a receipt, please provide the product identification number found on the back of your computer, along with the approximate date of when the computer was purchased.

How do I submit a claim?

You must submit a claim by May 30, 2014. 

You can submit a claim by filling out the Claim Form and submitting to the Claims Administrator by May 30, 2014.

 Follow the instructions in the Claim Form.
